§ 1 Contractual partner
These General Terms and Conditions apply to the business relationship between Barletta-Eis GmbH, Am Tempelhofer Berg 6, 10965 Berlin, and its commercial customers at home and abroad. Deliveries and services are carried out on the basis of the version valid when the order was placed.
§ 2 Conclusion of contract
Differing conditions will only be accepted after written confirmation. An order by telephone, fax or email is a binding offer; The contract is created through the consent of Barletta-Eis GmbH. The customer ensures the legally compliant import, promotion and use of the products. If you cancel, any costs or loss of sales that have already been incurred must be borne.
§ 3 Prices and payment
All prices are net plus sales tax and, if applicable, shipping and forwarding costs. Unless otherwise agreed, invoices are due within 14 days without deductions. Deliveries within Berlin must be paid for immediately upon handover, unless otherwise agreed.
§ 4 Delivery
Deliveries are subject to availability. Delivery times, delivery fees, shipping costs and inspection obligations upon delivery are based on the separate delivery conditions.
§ 5 Collection
Collection from the warehouse is possible Monday to Friday from 9:00 a.m. to 3:00 p.m.
§ 6 Transport damage
Obvious transport damage must be documented upon delivery and reported to Barletta Eis immediately so that claims against the transport company can be pursued.
§ 7 Retention of title
Delivered goods remain the property of Barletta-Eis GmbH until full payment has been made. It must be treated with care until ownership is transferred; Pledging, transfer of ownership as security, unauthorized transfer or interference by third parties must be reported immediately.
§ 8 Warranty
The statutory provisions and deadlines apply to defects unless a permissible deviation has been agreed. Damage caused by improper installation, operation, storage or connection does not justify any claims. For used goods, the period is one year. Barletta ice cream can initially make improvements or provide replacements; in the event of failure, legal rights apply.
§ 9 Product images
Product images show the status at the time of publication. We reserve the right to make technical, color and other changes.
§ 10 Image material
Image material remains the property of Barletta-Eis or the respective cooperation partners. Any further use or distribution requires prior written approval and is limited to the authorized purpose.
§ 11 Law and place of jurisdiction
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. To the extent permitted, the place of jurisdiction is the registered office of Barletta-Eis GmbH.
